Ex Parte Order Appointing Receiver and Order to Show Cause and Temporary Restraining Order—Rents, Issues, and Profits
California · Judicial Council of California · Effective January 1, 2007
This form is an order from the court that can be used without a hearing to appoint a receiver, which is someone the court names to take charge of property. It also sets up a date for a hearing where the person named as the defendant must appear to explain why the court should not confirm the receiver's appointment.
The court describes it as: States the court’s decision (order), without holding a hearing, to appoint a receiver (an agent of the court to hold property), gives notice of the date, time, and place that a hearing will be held about this appointment, and orders the defendant to come to that hearing to give any reason the court should not confirm its appointment of a receiver. Can also be used to order, until the time of the hearing, that the defendant give property to the receiver and not do things that might harm the property.
